1. About these Terms

These Terms & Conditions (“Terms”) govern your access to and use of the Anew Space website, The Kitchen Palette App, other digital products, content and related services (together, the “Platform”).

Anew Space is operated by Design Sage Pty Ltd (ABN 53 666 991 377) (“Anew Space”, “we”, “us” or “our”).

By purchasing an Anew Space product, creating an account or accessing or using the Platform, you agree to these Terms.

If you do not agree to these Terms, you should not use the Platform.

2. What Anew Space provides

Anew Space is a digital design and renovation platform intended to help users find inspiration, explore design directions, discover materials and products, and organise selections for renovation and interior projects.

Depending on your purchase and the features available to your account, the Platform may include:

curated Kitchen Looks and other design concepts;

curated Kitchen Look collections and other design collections;

material and product libraries;

material combinations and suggested alternatives;

conceptual layouts and drawings;

design tips and educational guidance;

supplier information and links;

supplier offers or discounts;

moodboards and palettes;

favourites and saved selections;

specifications and project information;

downloadable or shareable information;

guided design processes;

How To content and other educational material; and

other features, content and tools introduced by Anew Space from time to time.

The Kitchen Palette App is an online application that helps users explore curated Kitchen Looks, select and compare materials, build palettes and moodboards, and organise project specifications. It is not a downloadable mobile app.

The Kitchen Palette App currently offers the following purchase options:

The Kitchen Palette App Full Access — access to all four currently offered Kitchen Look collections: Calm Retreat, Timeless Ease, Light & Airy and Warm Japandi;

The Kitchen Palette App Calm Retreat Access — access to the Calm Retreat collection;

The Kitchen Palette App Timeless Ease Access — access to the Timeless Ease collection;

The Kitchen Palette App Light & Airy Access — access to the Light & Airy collection; and

The Kitchen Palette App Warm Japandi Access — access to the Warm Japandi collection.

These are different access options within the same application, not separate applications. Access to particular content and features depends on your purchase entitlement. Full Access refers to the kitchen collections included in that offering at the time of purchase; it does not automatically include separately sold products, future collections or future features unless expressly stated.

Features and content may evolve as we develop the Platform.

3. Anew Space is a design guidance platform

Anew Space provides general design inspiration, curation, educational information and planning tools.

Unless expressly agreed with you under a separate written professional-services agreement, content made available through the Platform does not constitute project-specific architectural, engineering, building, construction, structural, electrical, plumbing, legal, financial or other professional advice.

Images, layouts, drawings, dimensions, material combinations, specifications, tips and other content are intended as guidance and inspiration unless expressly stated otherwise.

You are responsible for determining whether any idea, material, product, layout or recommendation is suitable for your particular property, project, budget and circumstances.

4. Professional and site-specific advice

Every property and renovation project is different.

Before purchasing, ordering, fabricating, installing or constructing anything based on information found through Anew Space, you should verify all relevant information for your particular project.

Where appropriate, this includes obtaining advice or confirmation from suitably qualified professionals, tradespeople, builders, architects, engineers, designers, suppliers or other relevant specialists.

You are responsible for matters including:

site measurements and dimensions;

structural requirements;

building and planning requirements;

permits and approvals;

electrical and plumbing requirements;

waterproofing;

accessibility;

installation requirements;

product suitability;

technical specifications;

compliance with applicable laws, codes and standards; and

the final design and construction of your project.

Conceptual layouts or drawings available through Anew Space are not construction drawings unless expressly stated otherwise.

5. Product and material information

We aim to provide useful and accurate information about materials, products, finishes, suppliers, availability, pricing tiers and other design information.

However, products and supplier information can change.

Colours, textures and finishes displayed digitally may differ from physical products because of photography, rendering, screen settings, lighting, manufacturing variation and other factors.

Before purchasing a product or material, you should verify relevant information directly with the supplier and, where appropriate, obtain and assess a physical sample.

This may include checking:

current pricing;

dimensions;

colour and finish;

availability and lead times;

stock;

technical specifications;

warranties;

installation requirements;

suitability for your intended use; and

delivery or service availability in your location.

6. Third-party suppliers

Anew Space may feature, recommend or link to products, suppliers, manufacturers, retailers and other third parties.

Unless expressly stated otherwise, these third parties are independent businesses and are not agents or representatives of Anew Space.

A link, inclusion, recommendation or curated selection does not mean that we control the third party or guarantee its products, services, pricing, availability or conduct.

If you purchase a product or service directly from a third party, that transaction is between you and the third party and may be subject to that third party's own terms, warranties, delivery arrangements, refund policies and privacy practices.

Nothing in this section limits any rights you may have under applicable law.

7. Supplier discounts and offers

Anew Space may make supplier discounts, promotional codes or special offers available to eligible users.

Unless otherwise stated:

offers are provided subject to the relevant supplier's terms;

availability may change;

offers may have expiry dates or eligibility requirements;

products may be excluded;

suppliers may change or discontinue offers; and

an offer displayed on the Platform does not guarantee that a particular product will remain available.

Where reasonably possible, we will endeavour to keep offer information current.

8. Accounts

Some or all Platform features require an Anew Space account.

You must provide accurate information when creating or using your account and keep relevant information reasonably current.

You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.

You must not:

share account credentials in a way that enables unauthorised use of paid content;

access another person's account without permission;

attempt to circumvent access restrictions;

interfere with the operation or security of the Platform; or

use automated means to scrape, copy or extract Platform content without our permission.

Please contact us if you believe your account has been compromised.

9. Purchases and access

Certain Anew Space content and features are available only after purchase.

The content available to you depends on the product and access entitlement associated with your account. For The Kitchen Palette App, an individual access purchase provides access to the applicable Kitchen Look collection, while Full Access provides access to the four Kitchen Look collections described in section 2, subject to the product description at purchase. Other Anew Space products may be sold separately.

A purchase gives you a personal licence to access the applicable Anew Space digital content in accordance with these Terms. It does not transfer ownership of that content or its intellectual property to you.

Unless expressly stated otherwise, paid access is for the individual purchaser's personal use and may not be resold, sublicensed, redistributed or shared as a substitute for another person's purchase.

10. Upgrades and access options

Anew Space may offer eligible customers the opportunity to upgrade from an individual Kitchen Palette App access option to The Kitchen Palette App Full Access, or to upgrade other products where expressly offered. An upgrade does not automatically include separately sold Anew Space products.

Upgrade pricing, promotional discounts and eligibility may vary and may be changed or withdrawn for future purchases.

The price and terms presented to you at checkout will apply to that transaction, subject always to rights that cannot be excluded under applicable law.

11. Prices and payment

Prices are displayed in the currency specified at the time of purchase and include or exclude applicable taxes as stated at checkout.

Payments may be processed by Shopify or other third-party payment providers.

You are responsible for providing accurate billing and payment information.

A purchase is not complete until payment has been successfully processed or otherwise accepted.

12. Voluntary refund policy

In addition to any rights you may have under the Australian Consumer Law, Anew Space offers a seven (7) day voluntary refund policy for eligible digital-product purchases.

You may request a full refund within seven (7) days of purchase if you are genuinely unable to find a meaningful way to use the purchased product for your current or future project, and you have not used the product for personal, professional or client work. Requests are assessed under our published Refund Policy, which sets out the applicable eligibility requirements and request process.

This policy applies to eligible Anew Space digital products, including The Kitchen Palette App access options, other eligible design applications, Kitchen Layout Libraries and digital guides.

Once a refund has been processed, access to the refunded product and its associated paid content may be removed.

This voluntary policy is in addition to, and does not limit, any rights or remedies available under the Australian Consumer Law. Nothing in our voluntary policy prevents you from seeking a remedy to which you are legally entitled.

13. Australian Consumer Law

Our goods and services may come with consumer guarantees and other rights that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

If a product or service has a problem that entitles you to a remedy under the Australian Consumer Law, your rights are not dependent on satisfying the requirements of our voluntary refund policy.

In particular, any eligibility requirements or request procedures for our voluntary refund policy are not conditions of exercising a right or remedy you are entitled to under the Australian Consumer Law.

14. Intellectual property

Unless otherwise stated, the Platform and its content are owned by or licensed to Design Sage Pty Ltd and are protected by intellectual property laws.

This includes, without limitation:

Anew Space branding;

text and written guidance;

design concepts;

The Kitchen Palette App and its curated Kitchen Look collections;

Kitchen Looks;

curated material combinations;

imagery;

renders;

graphics;

layouts;

drawings;

guides;

databases and collections;

specifications and templates;

videos;

downloadable documents; and

the selection, arrangement and presentation of Platform content.

Purchasing access does not transfer ownership of this intellectual property to you.

15. Permitted use

You may use Anew Space content for your own personal renovation, home or interior project in accordance with these Terms.

You may share reasonable extracts of your own project selections or specifications with professionals and tradespeople involved in carrying out your personal project where this is necessary for that project.

You must not, without our prior written permission:

reproduce or distribute substantial parts of Anew Space;

resell or sublicense our content;

upload paid content to another website, platform, database or file-sharing service;

make paid content publicly available;

use our content to create a competing product or service;

systematically scrape, download or extract our content;

remove copyright, trade mark or proprietary notices;

represent Anew Space content as your own; or

use our content commercially except as expressly authorised.

16. Your content

You retain ownership of original content you upload to Anew Space, such as your own photographs.

You grant us a non-exclusive licence to host, store, reproduce and technically process that content to the extent reasonably necessary to operate the Platform and provide its features to you.

You represent that you have the right to upload content you submit to the Platform and that doing so does not infringe another person's rights.

We do not claim ownership of your original uploaded content merely because you use it within Anew Space.

17. Saved projects and specifications

Anew Space may allow you to save project information, moodboards, palettes, favourites, material selections, specifications and other information.

While we take reasonable steps to operate and maintain the Platform, you should not treat Anew Space as the sole permanent record of information that is critical to your renovation or construction project.

Where the Platform provides an export or download function, we recommend retaining your own copy of important final project information.

18. Availability of the Platform

We aim to provide a reliable Platform but do not guarantee that Anew Space will always be available, uninterrupted or error-free.

We may need to suspend or restrict access temporarily for maintenance, security, updates, technical problems or circumstances outside our reasonable control.

We may change, improve, replace or discontinue Platform features from time to time.

Where a change would materially affect paid access already purchased, we will act reasonably and in accordance with applicable consumer law.

19. Accuracy of content

We take reasonable care in preparing and curating Anew Space content.

However, renovation, design and product information can change, and errors or omissions may occasionally occur.

You should independently verify information that is material to purchasing, construction, installation or other significant project decisions.

Nothing in these Terms excludes responsibility that cannot lawfully be excluded.

20. Limitation of liability

To the maximum extent permitted by law, Anew Space is not liable for loss or damage arising solely from a user's failure to obtain appropriate project-specific advice, verify site conditions or measurements, follow applicable laws or codes, or verify third-party product information before making a purchase or construction decision.

To the maximum extent permitted by law, we are also not responsible for the acts or omissions of independent third-party suppliers, builders, tradespeople, manufacturers or other service providers.

However, nothing in these Terms excludes, restricts or modifies any liability, consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.

21. Acceptable use

You must not use Anew Space:

unlawfully or fraudulently;

to infringe another person's intellectual property or privacy rights;

to distribute malicious software;

to attempt unauthorised access to accounts, systems or data;

to interfere with Platform security or operation;

to harvest information about other users;

to circumvent paid access controls; or

in a manner that could materially damage Anew Space or its users.

22. Suspension or termination

We may suspend or terminate access where we reasonably believe an account is being used fraudulently, unlawfully, in material breach of these Terms or in a way that threatens the security or operation of the Platform.

Where reasonable in the circumstances, we will provide notice and an opportunity to remedy the issue before termination.

Nothing in this section affects rights or remedies available under applicable law.

You may stop using the Platform at any time.

23. Changes to these Terms

We may update these Terms as Anew Space and its features evolve or where required for legal, security or operational reasons.

The current Terms will be made available through Anew Space and will show the date they were last updated.

If we make a material change that adversely affects an existing paid user's rights, we will take reasonable steps to notify affected users and will not retrospectively remove rights that cannot lawfully be removed.

24. Governing law

These Terms are governed by the laws of Victoria, Australia.

You and Anew Space submit to the courts of Victoria and courts entitled to hear appeals from those courts, subject to any rights you may have under applicable consumer law.
